Terms of Reference – International Expert Trainers

for Innovative Trainings on Business and Human Rights

Purpose: The Denmark-Myanmar Programme on Rule of Law and Human Rights seeks two International experts (preferably as a team) with experience in business and human rights to provide trainings according to the terms of reference stated as below.

Length: 8 days plus designed be available online mentoring

Supervisor: Senior Legal Adviser of the Denmark-Myanmar Programme on Rule of Law and Human Rights

1)Background

The Denmark-Myanmar Programme on Rule of Law and Human Rights (2016-2020) supports the Union Attorney General’s Office, the Office of the Supreme Court of the Union, lawyers, CSOs as well as the law departments of Dagon and East Yangon Universities in strengthening capacities on core aspects of rule of law and human rights and supporting reform in relevant areas. The programme which has a total grant of DKK 70 million (approximately USD 10 million) is based on participatory approaches supporting partners to identify their own needs and priorities and taking lead in implementation of activities.

The governance of the programme is based on joint decision-making with partners through co-chaired Steering Committees. The programme is part of the Denmark-Myanmar Country Programme (2016-2020) endorsed by a bilateral government-to-government agreement between Myanmar and Denmark as well as MoUs with all key stakeholders. A Joint Venture comprised of the International Commission of Jurists (ICJ) and the Danish Institute for Human Rights (DIHR) has been contracted to provide technical assistance to the programme through a team of experts supporting implementation.

2)Description of the Assignment

The Consultants will develop the capacity of the law faculty staff of Dagon and East Yangon Universities to deepen understanding of key concepts relating to the significance and application of the UN Guiding Principles on Business and Human Rights (UNGPs). The training entails research on the Myanmar laws compared with international standards and the concept of human rights due diligence.

Sequencing: Two universities x 2-day trainings (4 days) and followed by: Two universities x 2-day trainings (4 days), i.e. 8 days in total, to be held at Dagon and East Yangon Universities respectively. The first training will be followed up by the second training with 4-6 weeks in between.

This is in accordance with the 2018 approved work plan and budget, specifically Activity 1.1.2 Introduction of new innovative teaching methodologies.

3)Objectives

The objective of the assignment is to strengthen the capacity of the law faculty staff to teach international human rights law incorporating concepts of business responsibility for promoting and applying human rights in general and the UNGPs in particular in the Myanmar social and legal context.

4)Outputs

The following outputs have been identified for a two-phased sequenced training:

· First: Two separate 2-day trainings on Business and Human Rights to be delivered at Dagon and East Yangon Universities

· Second: Forming a social media group for participants to share information and discussions, and for mentoring by consultants, for the period that participants are working on their group projects.

· Third: 4 to 6 weeks later, two separate 2-day trainings comprising seminar presentations by participants at each university

· Certificates of participation to be prepared.

· A brief report to summarise outcomes of evaluation forms and responses from trainers.

Payments shall be made in two instalments – 50% after the first training, 50% on completion of the second.

5)Activities of the Consultants

· Deliver 2 workshops for EYU and 2 workshops for DU, onsite

· Establish the social media group and be available for online mentoring

6)Qualifications of the consultants

· Substantial competence and experience in SE Asia delivering Human Rights trainings and Business and Human Rights trainings, including for persons whose first language is not English

· Experience in innovative training design and in the use of social media in trainings

· Proven track record conducting Business and HR trainings in SE Asia, and preferably to Myanmar participants and having

· Experience in business and human rights baselines in the Myanmar context and/or comparable SE Asian context.

· Social science degree and/or law degree

· Cultural sensitivity and commitment to DIHR values in the context of human rights.


How to apply:

Applicants need to provide the CV of the lead applicant (or applicants if bidding as a team), a technical bid of no more than 2 pages outlining their qualifications and expertise in undertaking the assignment, and a financial bid that includes daily rates and any other expected expenses. Applications will be evaluated both on technical and financial grounds.

Applications shall be received and considered on a rolling basis, however the JV will generally treat 30 July, 2018 as the cut-off date.
