Consulting Opportunity at World Vision International – Myanmar

World Vision International - Myanmar (WVM) is looking for National Consultant (Individual or group);

The purpose of this consultancy service is to develop the prosecution module for the case management system for victims of trafficking.

Period of Consultancy: June – July 2016

Background

WV is one of the INGOs entrusted by the Government of Myanmar (GOM) to provide reintegration assistance to Victims of Trafficking (VoT) in Myanmar. Since 2000, WV has implemented innovative Anti-Trafficking in Persons (A-TIP) projects focusing on prevention, protection, reintegration, and policy advocacy at local, national, and regional levels. This has included training of GOM officials such as police, Immigration Department, Department of Social Welfare (DSW) in victim centered screening, identification, and the (re)integration of victims. WV is currently implementing a project funded by the US government to improve victim-centered investigations and prosecutions of human trafficking cases and enhance victim protection in Myanmar.

The JTIP project will develop, test and implement a prosecution module for Case Management Training so that case managers can proactively protect and represent the rights of victims, as this is not currently part of the case management training conducted by UNICEF.

Scope of Work

This prosecution module for case workers is to equip the case worker with the knowledge and skills to support the victim throughout the criminal justice process.

The consultant is to have knowledge of existing criminal justice practices, rights of accusers and defendants according to the law, and challenges faced by victims as witnesses. This can be gained through meetings with the HTWG, UNICEF, AAPTIP, IOM, and other victim service agencies. The consultant is to also analyse information provided by victims that have participated in prosecution of traffickers as witnesses. World Vision will conduct discussions with victims to gain insight into their perspectives on the criminal justice process, which will be summarized and provided to the consultant for the assessment.

The prosecution module is to have the following content:

· overview of the criminal justice process and how the victim is involved as a witness or as a plaintiff;

· rights of the victim as a witness, including rights to consent or decline, rights to witness protection and rights to compensation;

· how the caseworker can support the victim at specific points of the criminal justice process;

· how to prepare the victim for what will happen in the courtroom, including developing the statement, giving testimony in court, fielding questions from the lawyers

· how to collaborate with police and prosecutor in the process;

· how to advocate for the best interests of the victim in the criminal justice process, including the use of video conferencing so that victims don’t need to face their trafficker in person

The consultant will develop the prosecution module so that it can be used as a supplement to the UNICEF Case Management System, which the case workers will be using to provide assistance to trafficking victims.

The consultant will first develop an annotated outline of the module, which will be reviewed by WV. The consultant will then draft the module, incorporating the feedback provided by WV. WV will also review and provide feedback on the draft module before the pilot testing. The consultant is to test the draft module through a pilot training event and a focus group discussion with participants after the training. The consultant is to finalize the module after making changes based on feedback provided by the participants in the pilot training.

Other consultation may be needed for developing the module. As the prosecution module will be based on an assessment of existing criminal justice practices, the rights of accusers and defendants, and the challenges faced by victims and witnesses, the consultant should conduct meetings with the HTWG, UNICEF, AAPTIP, IOM, and service providers to better understand the current approaches, needs and gaps. Moreover the consultant should consult with law enforcement and prosecutors in the development of the module to incorporate details and perspectives on the criminal justice process for TIP cases.

BACKGROUND AND EXPERIENCE

Knowledge about law enforcement on human trafficking, prosecution and criminal justice process, and understanding on how to develop the module. Understand the comprehensive service provision to Victim of Trafficking (VoT).
